This contract for the breeding season of 20_____ is made and entered into on this ____ day of _____________, 20____by and between Muddy Creek Farms herein after designated Breeder, and ________________________________________ herein after designated Mare Owner.  Mare Owner agrees to breed the mare _____________________________________ Reg. No. __________________________ to the stallion ______________________________________Reg. No. ___________________ for the fee of $_________________ for a live foal subject  to the following conditions.

1. The stallion fee includes a non-refundable booking fee of $100.00 payable with this contract, the balance of which must be paid with all other expenses when mare is picked up.  Mare owner may not remove mare from Breeder's possession until all expenses are paid in full.

2. Breeder agrees to provide suitable facilities for the care and feed of the mare and/or foal while in his custody.  Mare owner agrees to pay for care and feed at the rate of $10.00 per day wet or dry. Chute fee $250.00

3. Breeder will exercise judgment in care and supervision of mare and/or foal.  Breeder's veterinarian will examine mare for normal breeding conditions and will administer medical care deemed necessary for the health and safety of the mare and/or foal.  All veterinarian and farrier expenses will be paid by mare owner.

4. Breeder agrees to diligently try to settle mare; however, if mare fails to settle, for any reason, Mare Owner will hold Breeder blameless. Mare owner agrees to give Breeder ample opportunity to settle mare.

5. This contract contains a "Live Foal Guarantee".  A live foal is described as a newborn foal which stands and nurses without assistance.  If a foal is born dead there are return privileges only if Breeder is notified within one week and receives a veterinarian's statement confirming death.

6. It is agreed that should the mare miscarry, abort or prove barren after leaving the Breeder's premises Mare Owner has the privilege to return her for  breeding during the current breeding season, February through August, or the following year only.  Rebreeds will be honored only on mares properly vaccinated for Rhino.

7. A "Breeder's Certificate" will be issued for the foal conceived by this mating when the stallion fee and all other expenses incurred have been paid in full, and when the mare has produced a live foal from this mating.

8. Both parties agree the Stallion Owner, and Muddy Creek Farms, the Breeder, and any person associated with the Breeder is not liable for death, sickness, and/or accident including consequential damages caused to the mare and/or foal, and that the Mare Owner is not liable for death, sickness, and/or accident including consequential damages to the stallion.

9. If the mare dies or becomes unfit to breed before being pronounced safe in foal the breeder will accept another mare according to all the terms of the contract. 

10. This contract represents the entire agreement between the parties.

11. Mare Owner agrees that all mare delivered to Breeder's premises shall have:



• Negative Coggins test dated within 6 months of breeding
• Mare to be wormed within 30 days of breeding
• A copy of both sides of mare's registration certificate.

12.  Mares that are not halter broke will not be accepted.
